Kerala High Court Calls for Action Against Maritime Incidents and Financial Accountability

Kochi: The Kerala High Court has raised concerns over repeated maritime incidents off the state’s coast, urging the government to take action against shipping companies, including seizing their sister vessels. Chief Justice Nitin Jamdar emphasized that these incidents impose financial burdens on the public exchequer, stating that prompt action is crucial to prevent setting a dangerous precedent for future occurrences.

The court highlighted the need for both the Union and state governments to utilize legal avenues under the Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017. This law allows for the enforcement of maritime liens on vessels due to unpaid port dues or damages caused to port property. The bench insisted that costs incurred by the public should be recovered from those responsible for the incidents.

Additionally, the court inquired whether the National Investigation Agency (NIA) should be involved in the cases. Advocate General Gopalakrishna Kurup informed the court that an FIR has been filed and an investigation is underway. The court also noted the importance of addressing the economic losses stemming from pollution and the depletion of fish resources. To assist in the proceedings, the court plans to appoint an amicus curiae.
