The Department of Migrant Workers (DMW) Secretary Hans Cacdac recently announced a collaboration with the Maritime Industry Authority (Marina) to develop the Implementing Rules and Regulations (IRR) for the Magna Carta for Seafarers. The goal is to finalize the IRR by December, with planning set to take place in October and November. These regulations will establish administrative procedures and frameworks to support the implementation of the Magna Carta, going beyond its current provisions.
One of the key issues the Magna Carta aims to address is “ambulance chasing,” where lawyers aggressively encourage injured seafarers to file claims against their employers based on unrealistic promises. This practice has deterred some foreign shipowners from hiring Filipino seafarers. To combat this, the Magna Carta will include a provision for an independent medical doctor to provide unbiased medical findings and advice to seafarers and their families. This measure aims to ensure that seafarers are not misled by individuals or lawyers who may not have their best interests at heart.
Secretary Cacdac emphasized the importance of setting standards for various processes, such as reviewing seafarer contracts, in the IRR. The collaboration with Marina and the Department of Transportation (DoTR) underscores the commitment to enhancing protections for seafarers and promoting fair practices in the maritime industry. By introducing comprehensive guidelines and safeguards, the government aims to create a more transparent and equitable environment for seafarers and their employers.
