Indian authorities have initiated a criminal case against the owner, master, and crew of the containership MSC Elsa 3, which sank off Kochi’s coast on May 25, 2025. The vessel capsized approximately 13 nautical miles from Kerala after developing a severe starboard list, while en route from Vizhinjam to Cochin. All 24 crew members were rescued by the Indian Coast Guard.
Charges against the accused include reckless navigation and negligent handling of hazardous materials under various sections of the Indian Justice Code. The First Information Report (FIR) alleges that the crew operated the vessel carelessly, despite being aware it was carrying hazardous and flammable substances.
The sinking resulted in the loss of containers and the release of hazardous plastics into coastal waters, adversely affecting local fishing and blocking shipping lanes. Notably, 13 containers contained Calcium Carbide, a substance that can react violently with water.
An investigation was launched on June 10, directed by the Inspector General of Kerala Coastal Police. Authorities are set to record statements from MSC shipping representatives, the captain, and crew. Meanwhile, salvage operations are ongoing, with a 48-hour deadline to recover oil before monsoon conditions begin.
