JNPA and BMCTPL Resolve Container Terminal Dispute with Concession Extension to 2048

Jawaharlal Nehru Port Authority (JNPA) and Bharat Mumbai Container Terminals PVT. Ltd. (BMCTPL), a subsidiary of Singapore’s PSA International, have settled a long-standing dispute regarding the concession agreement for JN Port’s container terminal. The concession period has been extended by 1,173 days, pushing the new expiration date to March 8, 2048, beyond the original 30-year term ending December 22, 2044.

The Mediation and Comparative Committee (CSC) dismissed BMCTPL’s claims for damages, which were based on alleged delays in the start and construction of phase 2 at JNPA. The CSC ruled that the delays stemmed from external violent events rather than actions by the port authority. Consequently, all financial claims were retracted, and the dispute resulted only in a concession extension.

Additionally, BMCTPL will receive Rs. 9.49 Crore for a connecting road near Nhava Sheva Police Station and Rs. 3.51 Crore for related costs, with an interim payment until 15 days post-agreement signing. JNPA’s board has tentatively approved this modified concession pact, and a formal agreement is expected within a week. BMCTPL operates as a wholly-owned subsidiary of PSA Bharat Investment PTE. Ltd., part of Singapore’s Sovereign Wealth Fund.
