Drug Prosecutions Are Fueling the Seafarers Shortage Crisis

Stakeholders are calling for urgent legal reforms in response to the rising trend of unjust prosecutions of seafarers for drug-related offenses, while the true perpetrators evade justice. This issue poses a significant threat to the future of seafaring, exacerbating the global shortage of skilled maritime labor and undermining maritime trade. Seafarers play a crucial role in the global economy, operating over 100,000 merchant vessels that transport 90% of the world’s trade by sea.

Recent developments include a Federal High Court order to detain 22 crew members from the Brazilian vessel MV Aruna Hulya, following the seizure of 31.5 kilograms of cocaine. Critics, including Prof. Alfred Oniye of the Merchant Seafarers Association of Nigeria and USA, argue that these detentions often occur without concrete evidence linking crew members to the crime, violating the principle of “innocent until proven guilty.” Many crew members are unaware of narcotics smuggled aboard by organized criminal networks.

The emotional toll of prolonged detentions can be devastating, leading to social stigma and difficulties in finding new employment. Additionally, this trend is damaging the maritime sector, as the fear of wrongful arrests dissuades young people from pursuing careers at sea. Capt. Douglas Zakana of Izonibe Oil and Gas Marine Limited urges a shift in focus toward shipowners and cargo owners in drug trafficking cases, emphasizing the need for thorough investigations.

Emmanuel Maiguwa, President of the Maritime Security Providers Association of Nigeria, highlights the financial implications of maritime crime, noting that legal and operational costs can reach $6 million, creating a heavy burden for smaller operators. The call for reforms includes strengthening port security, establishing clearer legal protocols, and enhancing protections for seafarers, while also encouraging crew members to exercise vigilance and conduct background checks on potential employers.
