Philippines Seafarers’ Rights IRR Now Ready to Be Enforced

The Magna Carta of Filipino Seafarers has been officially enforced with the signing of its Implementing Rules and Regulations (IRR) by the Department of Migrant Workers (DMW) and the Maritime Industry Authority (Marina) in the presence of President Ferdinand Marcos Jr. The Republic Act 12021, also known as the Magna Carta of Filipino Seafarers, aligns with international maritime standards set by the Maritime Labor Convention (MLC) 2006 and the Standards of Training Certification and Watchkeeping (STCW) Convention. This law aims to provide comprehensive protection for seafarers, ensuring fair compensation, adequate training, and access to social and welfare benefits.

President Marcos emphasized that the signed IRR signifies a commitment to a well-prepared and competitive maritime workforce. The law includes provisions for mandatory shipboard training, fair treatment during illness or injury, and regulations to prevent exploitation. Marina Administrator Sonia Malaluan highlighted the IRR as a legislative milestone that upholds seafarers’ rights and addresses evolving challenges in the industry. The IRR comprises 22 rules that operationalize the law’s provisions, focusing on strengthening seafarers’ rights, promoting equality, and advancing maritime education and training.

The signing of the IRR was described as a historic milestone by Migrant Workers Secretary Hans Leo Cacdac, underscoring the government’s dedication to protecting and empowering seafarers. The IRR’s approval now allows various government agencies to develop policies and guidelines in line with the Magna Carta’s principles. Malaluan called for collective action in effectively implementing these rules to prioritize seafarers’ welfare. The IRR reflects a collective vision for a secure, respected, and prepared maritime workforce, highlighting the government’s commitment to supporting seafarers every step of the way.
