The Bureau of Customs in Philippines is taking action against fuel smuggling in the country by recommending charges against the crew members of two fuel tankers caught illegally transferring fuel at Navotas Port. The prosecutors have found reasonable grounds for filing criminal charges against the crew in violation of the National Internal Revenue Code and the Tax Reform for Acceleration and Inclusion (TRAIN) law. The failed fuel marking results initiated by the BoC were noted in the seven-page inquest resolution from the Office of the City Prosecutor in Navotas City.

Under the TRAIN law, individuals engaged in the sale, trade, delivery, distribution, or transportation of unmarked fuel can face fines ranging from P2.5 million to P10 million for multiple offenses, along with the revocation of their business license. BOC-CIIS Director Verne Enciso emphasized the commitment of the BOC and the Department of Justice to pursue fuel smugglers and those involved in illegal fuel transfers, known as the paihi system. Enciso stated that the BOC has been monitoring these activities and gathering necessary information to ensure appropriate legal action is taken against perpetrators.

The resolution recommending charges against the 23 crew members of the fuel tankers highlights the evidence and certainty of conviction in the case. Enciso assured that the BOC is working with other relevant agencies to put an end to fuel smuggling and illegal fuel transfers. The collaborative efforts aim to stop individuals involved in these illicit activities and ensure that they face the consequences of their actions.
