BIMCO has introduced a Biofuel Clause for Time Charter Parties to tackle the legal and operational challenges arising from the increasing use of low-carbon fuels in shipping. As the industry moves toward decarbonization, companies are adjusting their fuel strategies in response to evolving regulatory frameworks. However, integrating biofuels into charter agreements presents complexities, including concerns about fuel quality, engine compatibility, and liability.
The new clause offers clear definitions and fuel specifications that align with ISO standards, along with a structured process for sampling, testing, storage, and handling of biofuels. It includes provisions for performance adjustments based on varying calorific values of fuels, ensuring fair modifications to existing speed and consumption warranties within the charter party.
Additionally, the clause incorporates safeguards related to fuel stability, batch segregation, and storage life, promoting operational best practices for the safe use of biofuels onboard. BIMCO has previously published an LNG Annex to its Bunker Terms 2018 and is also developing annexes for methanol and ammonia bunkering, reflecting its commitment to facilitating the transition to alternative fuels in the maritime sector.
